Call for nominations for membership of the DMV Appeals Board

The Minister of Defence and Military Veterans, the Hon M.A. Motshekga hereby invites nominations by stakeholders, interest groups, veteran organizations and associations of suitably qualified individuals to be appointed as members of the Military Veterans Appeals Board. The Appeals Board is established in terms of Section 19 of the Military Veterans Act, (18 of 2011) to handle appeals as provided for in the Act.

Powers and Functions of Military Veterans Appeals Board:

The functions of the Appeals Board as provided for in the Military Veterans Act are as follows:

  • Consider any appeal lodged with it by a military veteran against any decision taken by an official in terms of this Act which adversely affects the rights of that military veteran;
  • Consider any question of law relating to military veterans referred to it by the Minister or the Director-General;
  • Advise the Minister or Director-General regarding any legal matter relating to military veterans which the Minister or the Director-General refers to it.
  • Report to the Minister on its activities (which must also be tabled in parliament).

Composition of the Appeals Board:

  • The Appeal Board consists of at least three persons appointed by the Minister in consultation with the association.
  • The Minister must appoint as members of the Appeal Board competent persons who have relevant knowledge, experience or expertise that would enable the Appeal Board to perform its functions effectively and efficiently.
  • At least one of the members of the Appeal Board must be an advocate or attorney or other legally qualified person with at least 10 years' experience in the practice of law.
  • The Minister must designate one of the members of the Appeal Board as Chairperson.

Requirements:

  • The persons who seek to serve on the Appeals Board must have relevant knowledge, experience or expertise that would enable the Appeal Board to perform its functions effectively and efficiently.
  • At least one of the members of the Appeal Board must be an advocate or attorney or other legally qualified person with at least 10 years' experience in the practice of law.

Term of office of the Appeals Board:

  • The term of office of for members of the Appeals Board is for a period not exceeding five years. A member is eligible for re-appointment for at the end of his/her term of office, but may not serve for more than two terms.

Remuneration of the Appeals Board.

The members of the Appeals Board who are not in the full-time employment of the state, will be remunerated in accordance with the National Treasury Guidelines on the Remuneration Levels: Service Benefit Packages For Office-Bearers of Certain Statutory and Other Institutions, Category B – Sub-category 1. The remuneration details will form part of the appointment contract.

Nomination Procedure:

  • Nomination must be in writing and submitted to the Director-General before or by the 30 May 2025
  • Every nomination must contain:
    • (i) Full written personal and career particulars of every nominee;
    • (ii) Full reasons and motivation for the nomination; and
    • (iii) The written and signed acceptance of the nomination by every nominee.
